PERSONAL INJURY – MEDICAL EXPENSES
Medical Expenses – Any cost incurred in the treatment of an injury.
Some typical medical expenses that are included in a personal injury lawsuit: emergency services (i.e., ambulance and/or helicopter transport), hospital bills, diagnostic testing expenses, doctor visits, surgery costs, therapy and rehabilitation costs, costs of prescription medicines. Medical expenses can therefore be very extensive, especially if the injured party has to undergo continued treatment or recurring medical care.
Medical expenses are considered to be “compensatory damages” in a personal injury cause of action. (Compensatory damages are paid to compensate the claimant for loss, injury or harm suffered as a result of another person’s negligence.) For this reason, it’s important to be very thorough when documenting injuries for the purposes of filing a lawsuit and maintaining records and receipts for treatments. It is also important to attend all medical appointments (doctors, therapy, diagnostic testing) as a part of your treatment toward recovery. Your treating physician is the person to determine if you have reached maximum medical improvement (not your attorney).
Above all, please avoid settling your case too early. (A claims adjuster will be all too eager to “help” you get immediate results from their company.) So before settling your claim, you should be certain that you are completely healed. And if you are a little overwhelmed by the whole process, you should consider hiring a personal injury lawyer. They can help you document the records necessary to review your whole claim, keep up with time limitations so protect your rights and let you focus on your healing.
