PERSONAL INJURY – PERMANENT DISABILITY
Ballentine’s Law Dictionary defines a permanent disability is one that “will remain with a person throughout” his or her lifetime, or he or she will not recover, or “that in all possibility, will continue indefinitely.”
Unfortunately, permanent disabilities from accidents happen far too often. Determining the extent of the injury is very important in the evaluation of your case. This can be either a physical or mental injury and can affect a person’s ability to work or perform daily activities through the duration of one’s life.
Evidence to be introduced in order to prove a permanent disability, include items such as medical documentation from treating physicians, ongoing medical treatment and rehabilitation efforts, medical bills for services of medical providers, proof of loss of income and the costs of ongoing treatment most of which will be included in the deposition of one or more physicians.
Other factors taken into consideration might include your age at the time of the accident and your medical condition before the accident (pre-existing conditions).
So whether you have an obvious permanent disability such as a permanent limp when you walk or a scar that everyone can see, in the world of the unknown, it is best to get a professional’s opinion before agreeing to settle your claims. We can guarantee the insurance company will be blind to anything that appears to be permanent. Let Ron Kim Law review the facts of your case and give you an opinion before signing any release with respect to your injuries.
